SPECIAL INSTRUCTIONS TO APPLICANT:

POSITION PURPOSE: The Executive Director for Civil Rights and Compliance, under administrative direction of the Vice President of People and Culture, provides strategic leadership and direction in fostering a diverse, inclusive, and equitable campus environment. The Executive Director ensures university compliance with federal, state, and local regulations related to Title IX, Americans with Disabilities Act (ADA), Discrimination, Harassment, and Retaliation (DHR), and other relevant laws and oversees investigations of discrimination, harassment, and retaliation. The Executive Director develops and implements policies and training programs and collaborates with campus stakeholders to promote a culture of equity, inclusion, and compliance.

In addition, the Executive Director serves as the Title IX Coordinator: DHR Administrator, ADA/Section 504 Compliance Officer, and Clery Director. This role is pivotal in advancing CSUB's commitment to justice, equity, diversity, and inclusion, thereby supporting the academic and social success of the university community.

DUTIES & RESPONSIBILITIES:

Civil Rights & Compliance Leadership

  1. Serve as the University’s Title IX Coordinator, Discrimination, Harassment and Retaliation (DHR) Coordinator, and ADA/Section 504 Compliance Officer in accordance with CSU Executive Orders.
  2. Identify, develop, and monitor university policies, procedures, and practices as needed to enhance efforts around Title IX and anti-discrimination compliance and initiatives to create a culture that exceeds the fulfillment of basic regulatory and procedural requirements with emphasis on fulfilling the justice, equity, diversity, inclusion, and belonging goals of CSUB.
  3. Prepare the University’s position in matters involving complaint investigations conducted by governmental regulatory agencies including the Equal Employment Opportunity Commission, Department of Fair Employment and Housing, the U.S. Department of Education’s Office of Civil Rights, Labor Commissioners, and Bureau of State Auditor.
  4. Develop and maintain a comprehensive compliance program procedures manual to effectively implement and execute university wide programmatic compliance activities.
  5. Serve on relevant committees, boards, and councils as appropriate.

Investigations & Oversight

  1. Oversee complaint investigations alleging violations of university policies prohibiting discrimination, harassment, retaliation, and sexual violence.
  2. Meet with the complainant on a regular basis to determine what interim supportive measures are necessary and ensure that such steps are taken.
  3. Conduct fact-finding investigations as needed, including interviewing the complainant, respondent, and potential witnesses, assessing the credibility of witnesses, drawing conclusions, preparing detailed written investigatory reports, and making recommendations for action. 
  4. Oversee and provide direction to the investigation team to ensure complainants and respondents are provided information regarding their rights and responsibilities, intakes and investigations are comprehensive and impartial, interim supportive measures are implemented as needed, and resolution of complaints is timely.

Training & Educational Programs

  1. Provide training and consultation to the campus community related to Civil Rights, equity, and diversity.
  2. Conduct regular and targeted trainings focused on the Prevention of Sexual Harassment, Discrimination and Retaliation, Reasonable Accommodation Under the Americans with Disabilities Act, Rehabilitation Act, California Fair Employment and Housing Act and other related Federal and State Law trainings.
  3. Develop educational programs and training materials relating to sexual harassment and sexual violence. 
  4. Regularly assess student activities to ensure that the practices and behaviors do not violate policies against sexual harassment and violence.
  5. Collaborate with other areas on campus to conduct trainings and provide guidance on issues pertaining to DHR/Title IX/ADA, including serving and leading advisory committees.  

Staff Supervision & Leadership

  1. Directly supervise assigned staff through selecting, training, evaluating, and disciplining as needed in accordance with university policies and procedures.
  2. Provide day to day operational leadership for staff through planning, organizing, and directing others in their work.
  3. Develop performance goals and metrics, ensuring alignment with the university's strategic objectives.
  4. Conduct regular performance evaluations, providing constructive feedback and identifying opportunities for professional development.
  5. Identify training needs for staff to enhance their skills and knowledge.

REQUIRED QUALIFICATIONS:

EDUCATION & EXPERIENCE – Equivalent to a bachelor’s degree from an accredited institution in Higher Education Administration, Human Resources, Law, Public Administration, Social Sciences, or related discipline and six (6) years of progressively responsible experience in equity and inclusion, compliance, human resources, legal affairs, or related field, including at least two (2) years of experience supervising or leading other staff.

SKILLS, KNOWLEDGE & ABILITIES (SKA’s) –

  • Regular and reliable attendance is required.
  • Knowledge of and ability to interpret federal and state laws regarding civil rights, discrimination, harassment, retaliation, and affirmative action.
  • Knowledge of case law, University policy, trends, and issues affecting higher education.
  • Capacity to oversee and conduct sensitive investigations, review investigation reports, and exercise judgement in making findings regarding whether violations of nondiscrimination, sexual violence, or sexual harassment policy or law have been committed.
  • Ability to develop, implement, and monitor policies and procedures related to equity, inclusion, and compliance.
  • Ability to design and deliver training and educational programs related to equity, inclusion, compliance, and related topics.
  • Ability to effectively mediate conflict and communicate across constituencies, while demonstrating empathy and understanding in situations concerning sensitive matters.
  • Ability to advise and consult on sensitive matters related to harassment and discrimination.
  • Demonstrated ability to convey sensitive information in written reports.
  • Demonstrated excellent written and oral communication skills at management level.
  • Ability to negotiate and resolve highly sensitive, complex and/or unprecedented problems.
  • Ability to commit in serving a diverse student population with cultural sensitivity.
  • Knowledge of and ability to interpret and abide by collective bargaining agreements.
  • Demonstrated customer service experience requiring a very high level of diplomacy and professionalism.
  • Ability to use tact and diplomacy to effectively handle a broad range of high level and sensitive interpersonal situations with diverse personalities, and to respond appropriately to conflicts and problems.
  • Ability to initiate, establish, and foster communication and teamwork by maintaining a positive, cooperative, productive work atmosphere in the University with the ability to establish and maintain effective working relationships within a diverse population and with those from various cultural backgrounds.
  • Excellent communication skills; ability to effectively communicate information in a clear and understandable manner.
  • Thorough knowledge of English grammar, spelling, and punctuation.
  • Ability to interpret, communicate and apply policies and procedures.
  • Ability to maintain a high degree of confidentiality.
  • Excellent organizational and time management skills with the ability to set own priorities to coordinate multiple assignments with fluctuating and time-sensitive deadlines.
  • Excellent computer skills and competence with a variety of computer applications including word-processing, spreadsheets, databases, on-line systems, Internet as well as online calendaring and email.
  • Working knowledge of or ability to quickly learn University infrastructure.
  • Must be willing to travel and attend training programs off-site for occasional professional development.
  • Must be able to work occasional holidays and adjust working hours to meet special jobs.  May be called back periodically to perform work as needed on an emergency basis.

PREFERRED QUALIFICATIONS:

  • Juris Doctor (JD) strongly preferred
  • Experience in a collective bargaining environment in a university setting.
  • Knowledge of CSU/California EEO policies, procedures, and regulations.
  • Demonstrated skills in an institutional/educational environment possessing a customer-oriented and service-centered attitude.

PHYSICAL DEMANDS: SEDENTARY WORK – involves mainly sitting; minimal walking and standing; lifting light weight objects limited to 15 pounds.

SPECIAL CONDITIONS:

SCREENING: Only those applicants possessing experience most directly related to the immediate needs of the office will be invited to appear before a Qualifications Appraisal Board for the purpose of appraising training, experience, and interest in the position.

BACKGROUND CHECK: Satisfactory completion of a background check (including a criminal records check) is required for employment. CSU will make a conditional offer of employment, which may be rescinded if the background check reveals disqualifying information, and/or it is discovered that the candidate knowingly withheld or falsified information.
