Job Duties

The Adjudication Officer for Independent Dispute Resolutions (IDR) in Long Term Care serves as a neutral and unbiased administrative hearing officer for facilities contesting state or federal regulatory citations and survey deficiencies.


The officer upholds due process through comprehensive review and analysis of the administrative record, including clinical documentation, investigative summaries, surveyor findings, facility statements, and written or verbal testimony from residents, families, or legal representatives when provided. Hearings are conducted in a fair, structured, and less formal environment than court, supporting transparency while maintaining the integrity of regulatory oversight and resident safety standards.


Following each hearing, the officer issues timely written findings and determinations, including a clear recommendation for an Agency decision (to uphold, modify, or dismiss a citation) and a concise, well-supported rationale aligned with regulatory and evidentiary requirements.

When adjudication activity is not in session, the officer provides direct support to the Long Term Care policy team, including:

· Regulatory research and analysis on federal and state best practices,

· Regulatory development support, including drafting and revision of policy guidance or regulatory language,

· Development of proposed legislation to enhance the Agency’s ability to fairly and responsibly license and certify long term care facilities in the Commonwealth,

· Review of and preparation of comments on introduced legislation which impacts the Agency’s licensure and certification of long term care facilities,

· Inspection and compliance trend research,

· Regulatory framework comparisons, and

· Policy planning and written product support to improve clarity, consistency, and system performance.

This position focuses on regulatory compliance outcomes, not contractual or payment disputes. The officer’s work influences facility compliance expectations, enforcement outcomes, and ongoing adherence to Medicare and Medicaid certification standards.


The role strengthens fair process, consistent policy application, and resident safety, while supporting modernization of Long Term Care oversight through policy development, regulatory strategy, and evidence-based system improvements.

Minimum Qualifications

Knowledge of Long-Term Care laws, regulations, and licensing requirements, with experience evaluating compliance, weighing material facts, and applying regulatory standards in a fair and consistent manner.

Knowledge of Medicare and Medicaid program requirements applicable to Long-Term Care providers, including conditions of participation and certification standards.

Knowledge of Long-Term Care standards of practice, health care management, and Life Safety Code requirements, with the ability to apply these standards to compliance reviews and deficiency determinations.

Knowledge of the Virginia Administrative Process Act (VAPA) and relevant provisions of Title 32.1 of the Code of Virginia related to licensure, enforcement, and appeals.

Ability to review and analyze complex administrative and regulatory records, including transcripts, exhibits, and supporting documentation, and synthesize findings into clear, defensible conclusions.

Ability to evaluate regulatory compliance and make recommendations regarding cited deficiencies, including scope and severity determinations.

Ability to assess and reconcile differing interpretations of facts and law, as presented by providers, legal counsel, survey staff, and agency personnel.

Ability to analyze legal arguments and written submissions and determine appropriate application of Long-Term Care laws and regulations.

Ability to conduct and participate in administrative proceedings (e.g., informal fact-finding conferences, IDRs, IIDRs) with professionalism and sound judgment.

Strong interpersonal, written, and verbal communication skills, with the ability to work effectively with diverse stakeholders in a highly regulated environment.

Additional Considerations

Degree in Law strongly preferred, degree in Health Care Administration, Public Administration, Health Planning, Business Administration or a related field also preferrable
