Job Duties
This attorney will provide advice and representation to agencies within the Health and Human Resources Secretariat, including the Departments of Behavioral Health and Developmental Services, Blind and Vision Impaired, and Deaf and Hard of Hearing and the Virginia Board for People with Disabilities. Duties will include primary responsibility for representing the Department of Behavioral Health and Developmental Services Office of Forensic Services and the Virginia Center for Behavioral Rehabilitation. This attorney will also represent the Department of Behavioral Health and Developmental Services in federal litigation brought under the Americans with Disabilities Act or alleging violation of federal laws with respect to conditions of confinement. This attorney will provide advice on interpretation of state and federal law and represent the assigned client agencies in state and federal court. The daily advice provided to the agencies will involve a variety of legal issues involving health and disability law, confidentiality and privacy laws, the Virginia Freedom of Information Act, and the Virginia Administrative Process Act. This attorney will provide back-up to the attorneys representing the Department of Health Professions, the Department of Health, and the Department of Behavioral Health and Developmental Services as needed.
Minimum Qualifications
The successful candidate must be a member of the Virginia Bar, possess excellent analytical, research, and writing ability, and demonstrate superior oral and written communication and litigation skills.
Additional Considerations
Five years of state and federal litigation experience is preferred.
