The opportunity
The Director leads the Litigation branch, a team that is responsible for the enforcement of laws and conducting litigation on behalf of the Environment Protection Authority (EPA).
About you
The ideal candidate will bring a diverse set of skills and experiences, including:
- Proven ability to lead prosecutions, civil enforcement and complex litigation
- Provide clear, candid legal advice to Ministers, Boards and Senior Executives
- Represent the EPA in high level negotiations and stakeholder discussions
- Skilled in briefing and managing external counsel to achieve strong outcomes
- Experienced in developing policies and procedures that support effective investigation and prosecution functions
- Committed to ensuring the EPA acts as a model litigant and uses recourses efficiently
Essential requirements
- Admission or immediate eligibility for admission as a legal practitioner of the Supreme Court of NSW; and holds or is eligible to immediately hold a current unrestricted practicing certificate in NSW
- Extensive proven experience and high level professional skills in litigation including prosecutions
- Demonstrated knowledge and expertise in legislation administered by the EPA and relating to criminal and civil enforcement
About the role and team
The EPA’s Litigation Team is a high-performing group of specialist in-house lawyers who prosecute and defend EPA cases in Court and who provide legal advice to the EPA across all areas of its work.
The Director Litigation:
- Leads the conduct of prosecutions, civil enforcement and other litigation to enforce laws administered by the EPA and represents the agency when decisions are challenged.
- Provides expert, frank and candid legal advice to the Minister, Board, Chief Executive, Senior Executives and internal stakeholders.
- Leads and represents, where appropriate, the EPA in high-level negotiations with external stakeholders.
