Job Summary:

The Assistant Chief Counsel (ACC) reports to the Chief Counsel and is to perform complex legal work for the Arizona State Board of Nursing.

The work involves providing legal advice, counsel and representing the Board and State's interest in resolving complaints received regarding licensed/certified nurses or certified nursing assistants who are alleged to have violated the Nurse Practice Act or other laws or rules, and legal support to the agency regarding any Board business.

Job Duties:

• Provides legal advice and consultation in complex Board matters of all types, including investigations and cases, and assisting with settlements

• Prepares legal documents, including but not limited to briefs, pleadings, memoranda, and analysis of legal, legislative, or other matters related to Board business

• Investigates; interviews respondents or applicants and witnesses, reviews documents and evidence; conducts legal research; conducts discovery; reviews and analyzes cases for settlement conferences or hearing

• Responds to inquiries from the public and occasionally other agencies, as assigned

• Attends meeting and trainings as necessary

• Other duties as related to the position

Knowledge, Skills & Abilities (KSAs):

Knowledge:

• Knowledge of the practical factors that impact litigation decisions and goals, including plaintiff responses, opposing counsel strategies and judicial perspectives, and victim/witness considerations

• Knowledge of legal techniques and the basic concepts of American Jurisprudence and of the formats used in preparing legal documents

• Knowledge of ethical standards applicable to lawyers and public employees, and ability to strictly follow those standards

• Knowledge, skills and abilities acquired through lengthy and varied experience in legal practice

• Knowledge and understanding of applicable statutes, case law and administrative procedures

Skills:

• Skill in persuasive oral and written communication pertaining to case presentation through various stages of representation, including settlements, or assisting with appeals, as assigned

• Skilled in interpersonal relationships as applied to interaction with agency personnel, complainants, respondents/applicants, witnesses, other government agencies, and members of the public

• Negotiating skills

Ability:

• Ability to identify issues, analyze and articulate legal arguments and recommendations, assess evidence, and communicate this information to board staff, board members, or members of the public, as assigned

• Ability to effectively and proactively plan, organize, direct, and monitor/track complex investigations/cases, with self-direction, time management skills, and demonstrating initiative

• Ability to coordinate activities with a variety of law enforcement agencies, governmental and non-governmental agencies

• Ability to exercise good judgment in making strategic decisions in cases and in providing legal advice

• Ability to apply analytical and problem-solving methods to systems and programs

• Ability to encourage teamwork through collaboration and communication

• Ability to appropriately apply professional ethical rules in daily practice

• Prepare legal documents memoranda and correspondence efficiently

• Ability to manage significant volume of high-risk cases

• Ability to display courteous and professional behavior

• Ability to effectively utilize skills of subordinate staff

Pre-Employment Requirements:

• Admission to, and good standing with, the Arizona State Bar is required (include on resume the date(s) of admission in Arizona and any other states). Candidate must have an active Arizona State Bar license

• Attorney applicants are required to submit a writing sample with their resume/application profile. The writing sample should contain an analysis of some substantive legal issue and provide insight concerning your ability to think and to explain and advocate for a particular position. Your record does not automatically constitute a bar to employment.
