Job Duties
The position serves as State-level Equal Opportunity (EO) Officer and liaison with the USDOL, Civil Rights Center on program-wide matters of EO and grant monitoring compliance activities. Serves as liaison with the USDOL, Civil Rights Center on matters of EO and grant program monitoring compliance activities. Directs the compliance monitoring of grant sub-recipient’s activities and the activities of the entities that receive federal grant award financial assistance through sub-awards issued by Virginia Works. Ensures that sub-recipients implement grant award plans and carry out activities in compliance with applicable federal and state regulations, policy, and guidance. Ensures that Virginia Works and its subrecipients are not violating their nondiscrimination and EO obligations under their grant programs. Monitors the collection of data ensuring compliance with the nondiscrimination and EO requirements of all Virginia Works grant programs and reviews the recipient's written policies to ensure those policies are nondiscriminatory. Develops and publishes the recipient’s procedures for processing discrimination complaints, including tracking the discrimination complaints filed against the recipient. Develops procedures for investigating and resolving discrimination complaints filed against the recipient, ensuring they are followed and made available to the public in appropriate languages and formats. Conducts outreach and education about EO and nondiscrimination requirements consistent with federal regulations. Oversees development and implementation of the recipient's Nondiscrimination Plan. Implements, monitors and enforces compliance with federal regulations of Section 188 of WIOA and 29CFR Part 38 regulations. Develops and delivers training and works with staff at Virginia Works, the VEC and local workforce development areas (LWDA) to meet business needs. Oversees staff responsible for developing and implementing a statewide compliance monitoring plan, ensuring compliance with applicable laws, regulations, and policies, including WIOA (uniform administrative requirements) and state and local requirements, policies and procedures.
Minimum Qualifications
• Comprehensive knowledge/experience in employment and civil rights laws, including related regulatory and statutory provisions, principles and practices; alternative dispute resolution; employee relations; and compliance monitoring.
• Strong leadership, conflict resolution, oral and written communication, interpersonal, compliance monitoring, and computer skills (e.g., MS Office Professional, MS 365, or comparable software).
• Ability to interpret and/or apply applicable regulatory and statutory provisions; ensure compliance with federal and state laws and regulations; effectively present information and conduct training; manage staff; build a successful team; prepare reports and plans; conduct reviews, evaluate and document findings, and initiate appropriate corrective action; conduct research, analyze information, develop sound conclusions, and communicate findings; and identify program needs, research possible solutions, and recommend corrective action.
Additional Considerations
• Certification or training as a mediator and extensive experience managing EEO and EO activities.
• Experience working with related state and federal laws and requirements.
