Job Duties

The Department of Human Resource Management’s Office of Employment Dispute Resolution is seeking a qualified individual to fill the position of Hearing Officer. The mission of the Office of Employment Dispute Resolution (EDR) is to provide state agencies and their employees with a broad range of workplace dispute resolution tools that ensure solutions consistent with the Commonwealth’s human resource policies and related law. Among these tools is the state employee grievance procedure, which affords covered employees with “an immediate and fair method for the resolution of employment disputes.” Va. Code § 2.2-3000. This position is integral to EDR’s obligation to provide fair and objective grievance hearings. The duties and responsibilities of the position include conducting administrative hearings related to state employee grievances appointed by EDR; resolving prehearing issues as appropriate, hold impartial hearing proceedings, and issue final written decisions to resolve issues qualified for hearing in accordance with the state employee grievance procedure, state and agency policies, and applicable laws; order appropriate remedies to include reinstatement, back pay, full reinstatement of fringe benefits, and seniority rights, or any combination of these remedies. This position will also issue reconsideration decisions as directed on appeal.

Minimum Qualifications

  • Extensive knowledge of employment law, particularly with respect to public sector employment.
  • Significant prior experience in administrative hearings or litigation.
  • Excellent legal research and writing skills.
  • Ability to work effectively with parties and their representatives, to communicate effectively orally and in writing, to maintain and demonstrate impartiality, and to work independently.
  • Strong skills in Microsoft Word, Excel, Outlook, and PowerPoint.
  • Ability to review and manage electronic files locally and in cloud storage.
  • Graduate of an accredited school of law with a J.D. degree.
  • Member in good standing with the Virginia State Bar
