Job description:

As one of the senior members of the Complaints and Oversight Unit, the focus of this position is on contributing to the efficient, effective and ethical operation of the Commission by managing the Oversight and Compliance Team, and providing high-level direction, research, analysis, advice and reports, including in connection with: • monitoring and reviewing the outcomes of misconduct matters, including police misconduct matters • own-motion investigations, particularly in regard to policies, practices and procedures, and • operational legal research. The occupant of this position will lead a team within the unit, provide leadership about operational issues and contribute to operational and strategic outcomes.

Hours per fortnight

73.50 hours per fortnight - flexible options available. 

Duties

  1. Lead the Oversight and Compliance team, including by:
    1. providing authoritative advice to senior managers
    2. undertaking and overseeing the conduct of research and drafting on good practice misconduct management
    3. providing mentoring and guidance, and managing workflow and performance reviews, and
    4. identifying, overseeing and undertaking Oversight and Compliance work, including audits and reviews of misconduct actions and investigations undertaken by public authorities, including liaising with, and providing feedback to, senior officials.
  2. Manage the Commission’s police misconduct oversight program, including:
    1. monitoring and analysis of police misconduct risk areas
    2. identifying, planning and conducting own-motion investigations into police misconduct
    3. identifying, planning and conducting individual and bulk performance audits of police misconduct complaints, and
    4. maintaining professional and cooperative, yet independent, engagement with senior police.
  3. Coordinate, oversee and undertake: own-motion investigations, particularly in relation to policies, practices and procedures; assessments; and investigations arising from complaints. This will include:
    1. assisting to identify, prioritise and scope misconduct risks
    2. collecting and analysing evidence, including preparing for and undertaking coercive interviews
    3. liaising with public sector employees and senior officials, and
    4. preparing comprehensive and high-quality reports about complex investigations, including factual findings and recommendations.
  4. Assist with the management of operational legal matters and issues relating to the Act and other relevant legislation, including:
    1. undertaking research into, and analysis of, legal issues, including drafting requests for advice
    2. liaising with external stakeholders, including the Office of the Solicitor-General, the Office of the Director of Public Prosecutions, and other senior legal staff from public authorities, and
    3. representing the Commission at interstate integrity agency legal forums and other events.
  5. Assist the Education and Engagement Unit in its education and prevention role by researching, developing and delivering misconduct education materials and presentations to public officers.
  6. Perform other duties as required by the CEO and Director, Complaints and Oversight.

Essential Requirements

The Head of State Service has determined that the person nominated for this vacancy is to satisfy a pre-employment check before taking up the appointment, promotion or transfer.

The following checks are to be conducted:

  1. A security vetting process to obtain Baseline security clearance (access to classified information and resources up to and including PROTECTED). This process requires the Australian Government Security Vetting Agency to collect personal information to assess suitability.
  2. A pre-employment check about any disciplinary or managerial action in any previous employment.
  3. Criminal activity
  4. Identification check.

Desirable Requirements

It would be desirable for the holder of the position to have any or all of the following.

  • Relevant tertiary qualifications such as in law.
  • Experience working in an integrity, regulatory, complaints and/or investigations environment.
  • Experience in, or understanding of, the conduct of compliance audits.
